By visiting the Site, submitting a quote request, or calling the number listed on the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
In short: East Nash Lawn Co. is a lead generation website. We connect East Nashville-area homeowners with independent, third-party lawn care providers. We are not a lawn care company, and we do not perform mowing, landscaping, or any other yard work ourselves. Any service you receive is provided and performed entirely by an independent provider, not by East Nash Lawn Co.
1. What East Nash Lawn Co. is — and isn’t
East Nash Lawn Co. operates a website that allows homeowners to submit information about their lawn care needs and receive contact from one or more independent, third-party lawn care providers (each, a “Provider”) who service the East Nashville area. We are a marketing and lead generation service. We do not employ, train, supervise, dispatch, insure, or directly contract with any Provider to perform work at your property, and we do not perform lawn mowing, edging, trimming, cleanup, or any other lawn or landscaping service ourselves.
Any agreement for lawn care service — including scope of work, scheduling, pricing, and payment — is made directly and solely between you and the Provider who contacts you. East Nash Lawn Co. is not a party to that agreement and has no obligation to perform, or ensure the performance of, any lawn care service.
2. No employment, agency, or partnership relationship
Providers are independent businesses. Nothing on this Site or in these Terms creates an employment, agency, joint venture, franchise, or partnership relationship between East Nash Lawn Co. and any Provider, or between East Nash Lawn Co. and you. A Provider is solely responsible for the manner, means, and quality of the work it performs, for its own licensing, insurance, and business practices, and for complying with applicable laws.
3. Submitting a request, consent to be contacted & eligibility
When you submit the quote form on this Site or call the phone number listed on the Site, you are asking to be connected with one or more Providers. By doing so, you consent to being contacted about your request — by East Nash Lawn Co., by a Provider, or both — by phone call, text message, or other means, using the contact information you provided, even if that number is registered on a state or federal Do Not Call list. Message and data rates from your carrier may apply. Consenting to be contacted is not a condition of receiving service, and standard opt-out options (such as replying STOP to a text) will be honored where applicable.
You agree to provide accurate, current information (including your name, phone number, email address, property address, and ZIP code) when submitting a request, and confirm that you are at least 18 years old and have authority to request service for the property listed. Submitting false, misleading, or fraudulent information, or otherwise misusing the Site (including interfering with its operation or reusing Site or Provider information for unrelated commercial purposes), may result in your request being declined.
4. Pricing, quotes & scheduling
Any pricing, quote, availability, or scheduling information you receive is provided by a Provider, not by East Nash Lawn Co. Quotes are estimates and are subject to change based on the Provider’s assessment of your property, access, and other factors. East Nash Lawn Co. does not set, control, guarantee, or collect payment for the price of any service, and we make no representation about the accuracy of any quote or the final cost of any service performed.
5. No warranties regarding provider services
Because East Nash Lawn Co. does not perform lawn care services and is not a party to any agreement between you and a Provider, we make no warranty or representation of any kind — express or implied — regarding the quality, timeliness, safety, legality, or outcome of any work performed by a Provider. Any dispute regarding the services performed, including workmanship, damage to property, scheduling, or payment, is solely between you and the Provider.
The Site itself, and all content, information, and materials on it, are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
6. Limitation of liability
To the fullest extent permitted by law, East Nash Lawn Co. and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of property, personal injury, or financial loss, arising out of or in connection with: (a) your use of the Site; (b) any service performed, or not performed, by a Provider; (c) any communication, contract, or dispute between you and a Provider; or (d) any content or information provided on the Site. This limitation applies regardless of the legal theory on which a claim is based, and even if we have been advised of the possibility of such damages.
To the extent any liability cannot be disclaimed under applicable law, East Nash Lawn Co.’s total liability to you for any claim arising from your use of the Site will not exceed one hundred dollars ($100).
7. Indemnification
You agree to indemnify and hold harmless East Nash Lawn Co. and its owners, officers, employees, and agents from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or any dispute between you and a Provider.
8. Your information
Information you submit through the quote form or by phone — including your name, contact details, property address, and any notes about your yard — is shared with one or more Providers so they can contact you and prepare a quote. We do not sell your information to unrelated third parties. By submitting a request, you authorize this sharing for the purpose of connecting you with a Provider.
9. Intellectual property
The Site, including its text, design, graphics, and the East Nash Lawn Co. name and logo, is owned by East Nash Lawn Co. or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without our prior written permission, other than for personal, non-commercial use.
10. Changes to the Site or these Terms
We may update, suspend, or discontinue any part of the Site at any time. We may also revise these Terms from time to time; the “Effective date” above reflects the most recent version. Continued use of the Site after changes are posted means you accept the revised Terms.
11. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Davidson County, Tennessee.
